The issue of fences is a common source of tension between neighbours and a topic that frequently comes up at Community Law Marlborough. The Fencing Act 1978 is the legislation that governs issues relating to fences. This act sets out some rules about who is responsible for work on fences, how to get your neighbour to contribute to the cost of a fence, and when work on a fence can begin. ‘‘work’’ which includes erecting, replacing, repairing and maintaining a fence, and also site preparation and any necessary survey. The act says that owners of adjoining lands are liable to contribute in equal proportions to work on a fence. Nevertheless owners are free to enter into their own agreement about this. Fences cannot encroach onto adjoining land, where the person erecting the fence is not the owner of that land. The owner of the land the fence encroaches on can apply to the court for removal of the fence. Removal of the fence in this situation would be at the expense of the person who erected it. If one owner wishes to compel the owner of the adjoining land to contribute to the cost of work on a fence, the act requires a fencing notice to be served on the owner of the adjacent land. The act sets out what is required of the notice and provides a template for the notice. If you as the neighbour are the recipient of the fencing notice and object the act says you must issue a cross notice. As with a fencing notice the act sets out the information to be included in a cross notice and a template for it. Using these templates means the risk of the notice being invalid is reduced. The act makes allowance if immediate work on a fence is required or the fence is damaged or destroyed and the owner (of the land in relation to the fence) Sore point: Often fences can be the biggest issues between neighbours. Photo: FILE would otherwise be liable for the damage. If a fencing notice is issued and no cross notice served, after a period of 21 days, work can begin on the fence. However, if this time frame is not adhered to, and work begins early, the owner who is erecting the fence will be liable for the full cost of the fence. Likewise if a cross notice has been served and there is still a dispute, but the neighbour who issued the fencing notice goes ahead, the objecting neighbour is not liable to contribute to the cost of the fence. In the interests of neighbourly relations the first step should always be to have a chat with your neighbour first. This will help decrease the risk of any future misunderstandings that could damage your relationship.
